How to demonstrate that the “The position offered is urgently necessary to employer’s business”​ when applying under OINP

The Ontario Immigrant Nominee Program (OINP) is a provincial immigration program that allows the government of Ontario to nominate individuals for permanent residence in Canada. The program is designed to attract highly skilled and experienced workers, entrepreneurs, and international students to the province

One of the employer requirements, when applying under “Employer Job Offer: Foreign Worker stream”, “Employer Job Offer: International Student stream”, and “Employer Job Offer: In-Demand Skills stream” is to demonstrate that the position offered is urgently necessary to employer’s business. In my opinion, an employer can satisfy this requirement by:

 

1.      Providing evidence of a business need:

Show that the position you are offering is crucial to the operations and success of your business. This could include documentation such as financial reports, market analysis, and customer feedback.

 

2.      Showing that the position cannot be filled by a Canadian citizen or permanent resident:

Provide documentation that demonstrates that no qualified Canadian citizens or permanent residents were available to fill the position. This could include job postings, recruitment efforts, and rejection letters from potential candidates.

 

3.      Explaining the impact of not filling the position:

Highlight the negative consequences that would result from not filling the position, such as decreased productivity, loss of revenue, or delay in projects.

 

4.      Providing detailed job duties and requirements:

Clearly outline the responsibilities and qualifications required for the position, and demonstrate how they align with the needs of your business.

 

5.      Showing that the foreign worker is the best fit for the position:

Provide evidence that the foreign worker you are offering the position to has the necessary skills, qualifications, and experience to excel in the role. This could include resumes, references, and work samples.

 

6.      Providing a detailed retention plan:

Show that the foreign worker will be retained after the initial period of the job offer and will be a long-term employee of the company.

Of course, the most transparent way to demonstrate the above requirement, is to simply apply for a LIMA.
